Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AlertForge (“AlertForge”, “we”, “us”). By using the service you agree to these Terms. If you do not agree, do not use AlertForge.

AlertForge has two categories of users: Streamers, who hold an account and use AlertForge to create alerts, accept viewer-generated alerts, and manage an overlay; and Viewers, who pay streamers through AlertForge to generate a custom alert that plays on a specific streamer's stream. Different sections apply to each.

1. Eligibility

You must be at least 13 years old to use AlertForge, and 18 or older (or the age of majority in your jurisdiction) to make any payment. If you use the service on behalf of an entity, you represent that you have authority to bind that entity. Streamers who enable paid viewer alerts must also meet Stripe's eligibility requirements.

2. Service Description

AlertForge provides tooling for creating stream alert assets, including generated media, hosted overlay links, and “Viewer Alerts” (also called “Viewer-Generated Alerts”) where a viewer pays a streamer to generate a custom AI alert that plays on the streamer's stream. Generated alerts are produced by third-party AI providers and may vary in quality.

3. Streamer Accounts

Streamers must provide accurate account information, keep credentials secure, and are responsible for all activity under their account. You may not share your account, impersonate another person, or reserve slugs you do not intend to use. We may suspend or terminate accounts that violate these Terms, Stripe's policies, Twitch's policies, or applicable law.

4. Viewer Alerts — How Payments Work

When a viewer pays to generate an alert for a streamer, the payment is processed by Stripe as a direct charge to a Stripe Connect account owned by the streamer. AlertForge acts as a facilitator and collects a platform fee per transaction (disclosed at checkout, currently $0.75 flat plus 10% of the alert amount). The streamer is the merchant of record for the remaining amount paid to them.

Viewers do not need an AlertForge account. A valid email is required at checkout so we can send an access link to manage, view, and fire the alert. The access link functions as a magic-link login that is valid across devices until revoked or rotated.

5. Refund Policy

All payments for Viewer Alerts are final and non-refundable except as required by law or as expressly provided below:

  • Render failure after multiple attempts: if your prompt cannot be rendered after our moderation provider rejects it, you may submit a different prompt at no extra charge. If no prompt can be rendered, you may request a refund to your original payment method.
  • Service-side error: if an alert is marked delivered but the overlay broadcast fails repeatedly through no fault of yours, you may request a refund.
  • Policy violation by the streamer: if a streamer is removed from AlertForge before your alert is fired, any unfired alerts you paid for are eligible for refund.

Refund requests must be sent to [email protected] within 30 days of payment and include the tip ID (from your confirmation email). Fired alerts are ineligible for refund. Chargebacks made without first contacting support may result in loss of access. Paid subscriptions and credit packs (separate from Viewer Alerts) are non-refundable except where required by law.

6. Content Rules (Viewer Alerts)

Prompts you submit to generate a Viewer Alert must be PG and non-infringing. You may not submit prompts that:

  • Target, depict, or defame real people (including public figures and other streamers);
  • Contain slurs, harassment, threats, sexual content, graphic violence, or illegal acts;
  • Infringe trademarks, copyrights, rights of publicity, or privacy rights;
  • Attempt to circumvent our moderation (encoded text, typo-workarounds, prompt injection);
  • Impersonate AlertForge, the streamer, a sponsor, or a platform (e.g. Twitch).

AlertForge and our AI providers may reject any prompt. A rejection does not imply the prompt is unlawful — only that we decline to render it. Repeated violations may result in the viewer being blocked across the platform and the associated email being flagged.

7. Streamer Obligations

Streamers who enable Viewer Alerts agree to: (i) complete Stripe Connect onboarding honestly and keep KYC information current; (ii) not coerce viewers into sending alerts containing disallowed content; (iii) honor the fire-on-live mechanic and not stage fake live states; (iv) comply with Twitch's Terms and the requirements of any other platform where the overlay is used; (v) handle applicable taxes on amounts received. Streamers are solely responsible for tax obligations on amounts paid to them through Stripe Connect.

8. User Content and License

You retain ownership of the text prompts and names you submit, and of any uploaded media you contribute. You grant AlertForge a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, and display that content and any AI-generated output derived from it, solely to operate, secure, and improve the service. For Viewer Alerts, you also grant the streamer a non-exclusive license to play back the generated alert on their stream in perpetuity.

9. Acceptable Use

You may not use AlertForge to: violate any law, infringe intellectual property or privacy rights, transmit malware, probe or breach security, scrape the service, evade rate limits, submit content that violates Section 6, resell the service without written permission, or interfere with any other user's use of the service. We may suspend accounts or invalidate viewer access tokens for violations.

10. Third-Party Services

AlertForge integrates with Stripe (payments + Connect payouts), Twitch (OAuth + EventSub for live-status), AI video providers, storage providers, and email-delivery providers. Your use of those integrations is also subject to their terms. We are not responsible for the availability or actions of any third party.

11. Intellectual Property

AlertForge software, branding, and platform content are protected by intellectual property laws. You may not reverse engineer, copy, resell, or reproduce the service except as permitted by law.

12. Availability and Changes

We may modify, suspend, or discontinue any part of the service at any time, including Viewer Alerts pricing and features. We will give reasonable notice of material changes where practical. We do not guarantee uninterrupted availability.

13. Disclaimer and Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, ALERTFORGE'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) $100 USD AND (B) THE AMOUNT YOU PAID TO ALERTFORGE IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL.

14. Indemnification

You agree to defend, indemnify, and hold AlertForge harmless from any claim arising from your content, your violation of these Terms, or your violation of any law or third-party right.

15. Termination

You may stop using the service at any time. We may suspend or terminate access for policy violations, abuse, fraud, chargebacks, or legal obligations. Upon termination, your right to use the service ends immediately; sections that by their nature should survive (including sections 8, 11, 13, 14, 15, 16) will survive.

16. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which AlertForge's operating entity is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, except where consumer-protection laws grant you the right to bring claims in your place of residence.

17. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when changes took effect. Continued use of the service after changes constitutes acceptance of the revised Terms.
